Upon consideration of Plaintiffs’ Motion for Summary Judgment as to Defendants John and Joseph Yeh [Paper No. 139], Plaintiffs’ Motion for Summary Judgment as to Defendant Viable Communications, Inc. [Paper No. 140], Defendant Mary Yeh’s Motion for Summary Judgment [Paper No. 141], Defendant Joseph Yeh’s Motion for Summary Judgment [Paper No. 143], and the various Oppositions thereto, oral argument having been held thereon, it is, for the reasons stated on the record at the hearing held on August 8,2011, this 12 day of August, 2011

1. Plaintiffs’ Motion for Summary Judgment as to Defendants John and Joseph Yeh [PaperNo. 139] is GRANTED IN PART AND DENIED IN PART. The Motion is GRANTED as to Counts I and II of the Amended Complaint. The Motion is DENIED as to all other Counts;

2. Plaintiffs’ Motion for Summary Judgment as to Defendant Viable Communications, Inc. [Paper No. 140] is GRANTED as to all Counts;

3. Defendant Mary Yeh’s Motion for Summary Judgment [PaperNo. 141] is GRANTED as to all Counts, and Defendant Mary Yeh is hereby DISMISSED from this lawsuit;

4. Defendant Joseph Yeh’s Motion for Summary Judgment [Paper No. 143] is GRANTED IN PART AND DENIED IN PART. The Motion is GRANTED as to Counts III, IV, V, and VI of the Amended Complaint. The Motion is DENIED as to Counts I and II; and

5. Judgment is ENTERED in favor of Plaintiffs and against Defendants Viable Communications, Inc., John Yeh, and Joseph Yeh, jointly and severally. Plaintiffs are awarded $567,443.43 in unpaid wages and an equal amount in liquidated damages, for a total of $1,134,886.86.
