The EEOC reasoned that default judgment was warranted because the agency’s dilatory conduct significantly prejudiced Sticha because its failure to fulfill its obligations for over a year after Sticha filed her complaint had a negative impact on Sticha’s ability to develop an impartial and appropriate factual record.
