What Happened in Court
Dos Santos was a Paris-based aircraft technician for Delta Airlines when he was retaliated against for having disclosed safety violations by his supervisor to Delta and to the Federal Aviation Administration (“FAA”). Dos Santos was concerned that his supervisor falsified safety clearance documents. After OSHA dismissed the complaint, Dos Santos appealed to the OALJ where the ALJ, on Delta’s motion to dismiss, determined that AIR21 did have extraterritorial application to Dos Santos’s claims.
