Law360, New York (June 26, 2013, 6:10 PM ET) — The U.S. Supreme Court’s mandate for federal recognition of lawful same-sex marriages means that employers must start offering many common benefits to employees in such marriages.
Occasionally, this will relieve a burden: Some companies have devised salary “gross-ups” and similar workarounds to equalize treatment of employees in same-sex marriages; such contortions will no longer be needed.
For most companies, however, this is a new issue. Employers should take immediate steps to ensure that they can be even-handed in their administration of any federal benefit that they currently offer only to employees in opposite-sex marriages…
